TAKE NOTICE that the Council of the Municipality of Clarington on October 30, 2023 considered an application under Section 34(1)2 of the Ontario Heritage Act to demolish or remove, or permit the demolition or removal of a building and/or structure on a Property designated under Part IV, Section 29 of the Ontario Heritage Act for the Property municipally known as 2020 Lambs Road, Bowmanville (also referred to as the former Boys Training School/ WWII Prisoner of War Camp 30).

The Decision of Council of the Municipality of Clarington, among other matters, regarding the application under the Ontario Heritage Act is as follows:

That Council support the recommendation of the Clarington Heritage Committee to refuse and not support the demolition of the Triple Dormitory building; and
That Heritage Permit Application File Number HPA2023-009 to demolish the Triple Dormitory building on the property located at 2020 Lambs Road (former Boys Training School and WWII Prisoner of War Camp 30) be refused;

Notice of an appeal of the decision of Council on the application to demolish or remove a building and/or structure on the Property may be served on the Municipal Clerk within 30 days of the date of this Notice, which is December 8, 2023:

A Notice of Appeal must:

Set out the reasons for the objection to the decision;
Set out the reasons in support of the objection; and
Be accompanied by the fee required by the Ontario Land Tribunal payable to the Minister of Finance.

Who Can File an Appeal

Only the owner of the Property subject of the application under Section 34 of the Ontario Heritage Act may appeal the decision of Council of the Municipality of Clarington to the Ontario Land Tribunal under Part IV, Section 34.1 of the Ontario Heritage Act. The appeal may only be made where Council has consented to an application to demolish or remove a building and/or structure on a property with certain terms or conditions, or refuses the application to demolish or remove the building and/or structure on a property.
